Auto Accident Attorney in Beaverton & Portland, OR
20+ Years Helping Injured Clients | Milla Law

This is the most common way our clients get injured, and we have been handling these cases for over 20 years. Automobile accidents cause people to suffer injuries, lose time from work, and require medical care (oftentimes for many months). Accidents also cause numerous other problems like total loss vehicles or repair issues, rental vehicle issues, and sometimes even the diminished value of a vehicle. We help our clients navigate their own auto insurance policy and the benefits that are available to them, provide guidance on vehicle issues, and ultimately obtain fair compensation for their injuries.

If you have comprehensive and/or collision coverage on your vehicle, your insurance company will fix your vehicle, no matter who caused the accident. If your insurance company repairs your vehicle, you will be responsible for paying the deductible. However, if the accident was not your fault, the other insurance company should reimburse your deductible. Also, if the accident was not your fault, you can have the other driver’s insurance company pay to repair your vehicle.

Even if you have “full coverage,” your insurance company may not cover rental car charges. Check with your insurance company before you rent a car. If the accident was not your fault, the other driver’s insurance company should pay for the rental car directly to the rental agency. Be careful when renting a vehicle because insurance will only pay for the cost of the rental with no additional charges. If you sign up for additional insurance or personal coverage, this is not usually covered.

A “total loss” does not necessarily mean your vehicle cannot be repaired. It more likely means that, in the view of the insurance company, the cost to repair your vehicle is more expensive or close to the total value of your vehicle. Oftentimes a “total loss” is more of a financial analysis than a repair issue. Even if your vehicle is deemed a “total loss,” you still have some options that we can discuss with you.

Your Oregon auto insurance policy automatically includes personal injury protection (PIP) coverage to pay medical bills regardless of who was at fault in an accident. However, there are limitations to your PIP coverage, such as time and expense limitations. Please be aware that if you have an auto insurance policy from another state like Washington or California, that policy may not cover medical expenses or time off work.

Oregon auto insurance policies automatically include personal injury protection “PIP” to cover your medical expenses even if the crash was your fault. In many cases, your insurance will also cover your time off work. However, PIP coverage is subject to limitations that we can explain in detail.

If the accident was caused by your mistake and your vehicle needs repair, your insurance will only help if you have comprehensive or collision coverage. If you have only liability coverage, and the accident was due to your mistake, your vehicle will likely not be repaired by any insurance company.

Your Oregon auto insurance policy will partially reimburse missed work through personal injury protection coverage (PIP). This coverage is subject to certain limitations that we can explain in detail.

Your Oregon auto insurance policy includes “uninsured motorist’s coverage” so that you can still seek compensation if the accident was not your fault.  Also, your Oregon personal injury protection coverage (PIP) will pay your medical expenses and reimburse some lost wages. However, whether your vehicle damage caused by an uninsured motorist will be covered by your insurance depends on your particular policy which we will review with you.

There is no schedule or exact formula to answer this. The value of each case depends on the specific circumstances surrounding each accident or injury. Any result will depend on the level and extent of injuries, medical treatment received, the amount of lost wages or lost earning potential, and the amount of pain and suffering involved. We also take into account the conduct of the other driver. Once we learn the particulars of your case, and review your medical and employment records, we provide clients with a realistic estimate of what we think we can obtain in your case.
