Frequently Asked Questions From Beaverton Personal Injury Clients

Wondering what to do after an accident? Discover answers to the questions our personal injury attorney gets asked most often.

If you are a victim of sexual or physical abuse, there may already be a criminal case pending against the offender and the district attorney’s office should be in regular contact with you. As a victim you also have the right to hire your own attorney so you can consider pursuing a civil claim against the perpetrator for monetary compensation. We have experience reviewing and pursuing these types of claims, and even if we are not retained in your case, we can at least give you some guidance towards what to expect. Another valuable resource for crime victims is the Oregon Crime Victims Law Center: OCVLC.org.

Victims of intentional crimes like sexual abuse or assault have an individual right to seek civil compensation against their offenders. Many times, these claims are brought directly against individuals, but they may also include claims against agencies, companies, or others who may be responsible for the offender’s conduct or failing to protect the victim (such as vulnerable children). These cases are complex and require investigation into the facts and potential claims that may be viable, all of which we will cover with you during our initial free consultation.

Many abuse victims are small children when the abuse occurs, and either cannot or do not bring a claim until many years later and after they are adults. The law recognizes these cases are not typical and they often allow more time to investigate and bring the claim, but as with many legal issues, it depends on the facts and circumstances of each case.

Individuals who are in jail, prison, or juvenile detention have the right, like anyone else, to bring a civil claim for abuse or harm that is done to them while in custody. The short answer is “yes,” you may bring a claim for harms you suffer while you are incarcerated. These cases do involve strict timelines and notice requirements, so if you or someone you care about has a potential claim please reach out to an attorney as soon as you can to protect their rights.

If a child is abused, harmed, or injured while in foster care, we can help. Sadly, foster kids may be the victims of neglect (whether intentional or not) which can lead to serious injury or harm. In other cases, children may be abused or assaulted by others within the foster care system (including other children). Like other cases involving governmental agencies, the law may require strict compliance with time and notice requirements, so do not hesitate to reach out with this type of case for our free consultation. We have experience investigating and litigating these types of cases.
